While not all hail storms contain large sized hailstones nearly all can cause varying forms of property damage. Hail can vary in size from very small to individual hailstones the size of baseballs.

According to the NOAA (The National Oceanic and Atmospheric Administration) the largest hailstone on record fell in South Dakota on July 22nd, 2010. It was the size of a volleyball.

Per the NOAA:

“Even after melting, the stone still measured 8.0 inches in diameter and weighed nearly 2 pounds (1 pound, 15 ounces) with a circumference of 18.62 inches.

“After a thorough review of the evidence, NCEC — the team responsible for validating national weather records — declared Scott’s hailstone to be the largest in diameter and heaviest ever recovered in the United States.

Scott’s hailstone displaces the previous hailstone record for weight, which was previously 1.67 pounds for a stone in Coffeyville, Kan., that fell in 1970. It also surpasses the record for diameter, which was 7 inches for a hailstone found in Aurora, Neb., in 2003. The Aurora hailstone still holds the record for circumference of 18.75 inches.”

State Farm Insurance sued in Class Action lawsuit for pushing ServPro and Service Master on their policyholders.

The lawsuit contends that State Farm has a relationship with ServPro and ServiceMaster that are part of State Farm’s Preferred Service Provider (PSP) referral program for water damage mitigation that is known as State Farms Premier Service Program.

Preferred Service Provider relationships are very common in the Insurance world and lawsuits involving such are not as uncommon as insurance companies would like people to believe.

Many Public Adjusters and Attorneys believe that this is a fatally flawed mechanism that works to the detriment of the insured or policyholders. Why you might ask, well they often strongly suggest that you use their “pre-screened, pre-qualified, and warranty backed contractors” for your own benefit and safety. At times they will even just have the Preferred Service Provider Contractor or Vendor come straight out to your home or building to start work without ever having really consulted with you, the insured about it. At that time the PSP will have you sign legal paperwork authorizing them to do the work often in the form of a Work Authorization or Repair Contract. Note that contract or agreement is now between you and the PSP. Oh smack, the liability has shifted from the Insurance Company pushing or touting the PSP to the PSP and you for using them. See how that worked.

Often their paperwork will have a direct pay authorization that allows them to bill the insurance company directly for the work they performed. This in and of itself is not necessarily wrong or out of order, as this is fairly common in the industry. What happens more often then not, at least based on my own experience with Insurance Companies and their contractor’s (PSP’s), is that they almost never prepare an estimate for what is to be done prior to them starting work. They almost NEVER provide the insured with the estimate and invoice once it is done. I was just working on an underpaid claim, not with State Farm, where the contractor sent out by the insurance company told the homeowner that they could not give their estimate or invoice to the homeowner. The contractor told the homeowner that they had to submit it to the insurance company. Imagine that, if the insurance company didn’t pay do you think they would have provided it to the homeowner? Once I was able to obtain copies of those documents, upon examination, it became obvious that things were invoiced for that clearly were not done. Upon further investigation I found that the insurance company contractors, yes there were two contractors involved, were not properly licensed to do the work they did do.

They often like to tout how they have prescreened these vendors or contractors and that the CONTRACTOR or VENDOR provides a certain term warranty for your benefit. THEY FAIL TO TELL YOU that they carefully and skillfully attempt to remove any liability that they might have regarding that contractor or vendor. THEY FAIL TO TELL YOU that contractors / vendors on their Preferred Service Provider network or program typically have to sign contracts with the insurance company agreeing to things that could restrict their ability to act properly on YOUR BEHALF. THEY FAIL TO TELL YOU that many, if not all of these Preferred Service Providers are afraid to lose work if they disagree with the insurance company on estimate damages or repairs. A Contractor or Vendor that doesn’t conform will not be feed work and will typically be removed from their PSP program.

It will be interesting to see how this pans out in court.

Winter Storm Jonas and the property damage and safety risks it can cause.

As Maryland and Washington D.C. are at the heart of the most intense part of the winter storm Jonas that is bringing record amounts of snow and blizzard conditions not seen in many peoples lifetimes, As a Public Adjuster and an Insurance Restoration contractor that deals with insurance claims and property damage on a daily basis I wanted to offer some things for Homeowner’s and Business Owner’s to think about and keep in mind regarding safety and property damage.

Here are some things to think about as we endure Mother Nature’s beauty and wrath.

1.) The weight of snow, ice and water can cause substantial property damage to Flat Roofs, Low Pitched Roofs, Carports, Sheds, Decks, etc… These structure’s may not be rated for the weight (loads) that they may have on them due to Winter Storm Jonas.

2.) Low sustained temperatures can cause property damage as a result of Freezing or frozen pipes. Commonly called Freeze Damage. Pipes will often fail, burst, split or separate as a result. This then cause water to escape from that system which can cause water damage. Freeze Damaged Pipe

3.) Back Up of Sewer or Drains and Sump Pump Failure or Overflow can happen from power outages or loss of power, mechanical failure or even from inundation as things start to melt.

4.) Most people don’t know but there is what we in the industry actually call a fire season. The amount of structure fires tend to spike between November and March. Primarily due to more time being spent inside, fire places and wood burning stove’s being used, furnace’s being turned on for the first time that season, Christmas trees and Christmas lights, candle usage etc… Make sure you have properly functioning Smoke and Carbon Monoxide alarms. There were nearly 500,000 structure fires in 2014 (Latest Statistics available). Cooking equipment was the number one cause with Heating equipment following in second place. With fires also typically comes large amounts of water damage.

5.) Ice Dams can cause serious damage to roofing materials and the interiors of homes, buildings or structures. An Ice Dam is when ice backs up underneath the roofing materials and ultimately causes damage by the ice itself and the inevitable melting of the backed up ice, which can cause water damage to interior components also as a result.

These are just a few things off the top of my head that homeowner’s and business owner’s need to be mindful of.

These types of property damage should typically be covered by the most common types of property or homeowner’s insurance. Having said that, there may be certain exclusions that would appear to limit or may disallow coverage. I have seen more than enough insurance claims that were either completely DENIED or PARTIALLY DENIED that were indeed covered. Insurance company’s NOT properly paying claims or underpaying insurance claims, in the industry we call this low-balling, is more common than most people think. I deal with these things on a daily basis. Insurance policies are complex and confusing documents that are created by the insurance company, to which you have no say over. They are essentially a take it or leave it proposition.
